Criminal Possession of a Weapon in the 4th Degree  


The criminal statutes relating to Criminal Possession of a Weapon in the 4th Degree and the definition of gravity knife constitute the focal point of his gravity knife practice.  Under
New York Penal Law 265.01, it is a crime to possess a “firearm, electronic dart gun, electronic stun gun, gravity knife, switchblade knife….”

 

  • It does not matter what a person plans to use the knife for, with a few exceptions.
  • It does not matter if the person knew the knife was illegal.
  • It does not matter if the person is not using the knife.

Under New York Penal Law 265.00(5), a gravity knife is “any knife which has a blade which is released from the handle or sheath thereof by the force of gravity or the application of centrifugal force which, when released, is locked in place by means of a button, spring, lever or other device.”

 

If convicted of Criminal Possession of a Weapon in the Fourth Degree, you face:

  • Up to one year in jail (a “Class A” misdemeanor) if the person has not been previously convicted of a criminal offense.
  • Up to seven years in jail (a “Class D” felony) if the person has previously convicted of a criminal offense.
